Our Practice

The lawyers at Geraghty + Associates have done work in virtually every area of real estate law. Without limiting the scope in any way, the practice of the firm can be divided into four key areas:

    With respect to general legal services provided regarding the development and management of real estate, representative projects include the following:

  • Advised national title insurance companies on title and encumbrance issues affecting commercial and residential real estate.
  • Advised residential real estate developer in connection with land acquisition, including negotiation and drafting of agreements of sale, obtaining governmental approvals for development and development of covenants for land use.
  • Negotiated disputes on behalf of developer with local municipality and Allegheny County taxing authority regarding tax assessment and transfer tax issues.
  • Resolved disputes between shopping mall owner/developer regarding allegations of person injury.
  • Secured approval of complex subdivision plan for commercial development, involving the combination of several parcels and railroad easements, from two affected municipalities.
  • Negotiated disputes with lienholders to permit sale of commercial property. Advised developer in conveyance of lots in large parcel of land located in a commercial corridor, but immediately adjacent to residential areas. This project included obtaining subdivision and land-use approval, coordinating conveyances, including financing, of six parcels of real property, in multi-party, staggered transactions, drafting and negotiating a reciprocal easement and maintenance agreement, negotiating and coordinating highway occupancy permits, relocating municipal and state roadways, adding and revamping of traffic signalization, relocating utility lines, including municipal authority owned sewage lines, which resulted in the development of a five story medical office building, a full service restaurant, multiple story retail facility, and two multi-story office buildings.

    In the area of judicial and administrative proceedings, the firm's experience includes:

  • Assisted commercial property owner in successfully securing necessary zoning hearing board approvals.
  • Assisted private residential developer in successfully defeating challenges to proposed residential developments initiated by adjoining property owners.
  • Handled disputes with construction contractors on behalf of property owners.
  • Represented property owners in quiet title actions to clear title of properties for sale.
  • Represented architect and developer in dispute regarding construction defects in conversion of a former church building into condominiums.
  • Negotiated disputes on behalf of developer with local municipality and Allegheny County taxing authority regarding tax assessment and transfer tax issues.
  • Represented property owners in tax assessment appeals and various challenges to the valuation of property.
  • Represented current property owners concerning the location and scope of access easement granted by prior owner in chain of title
  • Assisted individual and commercial property owners and lessees in the resolution of condemnation and valuation matters before the Board of Viewers and appellate courts.
  • Represented developers and architects in disputes regarding adequacy of renovation and construction projects

    With respect to the negotiation and closing of real estate transactions and leasing, our experience includes:

  • Assisted major regional property owner in establishing standard lease terms, and negotiating points for office and modular, high-tech office/warehouse and industrial facilities.
  • Assisted residential real estate developer in negotiating and documenting development financing, establishing parameters for and preparation of contracts for sale to residential builders and to the ultimate residential property owners, and negotiating agreements with real estate brokers for the development and sale of residential properties.
  • Assisted local utility in securing numerous easements over public, private and railroad land to facilitate upgrade of service.
  • Advised commercial real estate developer in connection with entering into long-term lease agreements and preparing supporting documentation.
  • Developed and negotiated commercial lease agreements for developer that owns numerous properties in the Pittsburgh area.
  • Drafted and negotiated leases with tenants for major downtown office building on behalf of purchaser.
  • Developed residential lease agreements, policies and procedures and rules and regulations for a 300 unit complex, including units leased to HUD assisted tenants for diversified commercial property development and management company which owns and manages over two million square feet of industrial, office, retail and apartment properties in four states.

    With respect to specialized work for non-profit and public entities, our experience includes:

  • Served as counsel to Housing Authority during the 1980's in litigation relating to defective construction and renovation of the Glen Hazel town homes, reviewed Housing Authority records of contracting, inspection and payment, developed and coordinated testimony of Housing Authority employees and expert witnesses, and negotiated resolution to correct deficiencies.
  • Successfully argued to the Pennsylvania Supreme Court on behalf of a non-profit corporation to clarify the definition of Purely Public Charity under the Pennsylvania Constitution permitting residential properties housing the disabled to be tax-exempt.
  • Acted as counsel to a local housing development corporation, handling community development block grant loans for housing projects in eastern Allegheny County, and preparing documentation for sale and lease of low-income housing.
  • Prepared extensive title abstract for local religious institution in a dispute with its national governing body regarding ownership of property, also rendering advice regarding possible litigation of dispute.
  • Conducted risk management assessments of client service organizations to identify and minimize potential liabilities.
  • Assisted specialized medical clinic operator in resolution of zoning and land use issues regarding facility.
